How We Help

Cyclists Face Unfair Payouts

You were riding legally — in the bike lane, on the shoulder, following traffic laws — and a driver hit you. Now you're injured, your bike is destroyed, and the insurance adjuster is already building a case that you somehow contributed to what happened.

This is the standard playbook for bicycle accident claims, and it works — when the cyclist doesn't have the right attorney.

The bias against cyclists in personal injury cases is real and well-documented. Adjusters know that jurors in many communities harbor implicit assumptions about cyclists: that they're unpredictable, that they shouldn't be on the road with cars, that they take risks. Even when those assumptions are wrong, they color how fault gets assigned if a case goes to trial. And they shape how early offers get structured, because the insurer knows the cyclist may be reluctant to fight.

The result: cyclists are frequently offered less than what the same injuries would generate in a standard car accident case. And cyclists who are unrepresented — or represented by attorneys who don't understand the specific dynamics — often accept it.

What Makes Bicycle Accident Cases Uniquely Complex

The injuries are severe. A cyclist hit by a motor vehicle absorbs force that a car occupant would absorb through multiple protective systems — airbags, seatbelt, steel frame. There is no crumple zone on a bicycle. Traumatic brain injury, even with a helmet; road rash that requires surgical debridement; broken clavicles, wrists, and arms; spinal injuries; internal trauma — these are common outcomes in bicycle accidents with motor vehicles. The initial medical visit rarely captures the full picture.

The fault arguments are aggressive. Alabama's pure contributory negligence standard means that if a driver's insurer can establish any fault on the part of the cyclist — any at all — the cyclist may recover nothing. Adjusters routinely argue: "You should have been more visible." "You ran the stop sign." "You weren't using proper signals." These claims are often fabricated or exaggerated, but they require evidence to counter.

The coverage situations vary. The at-fault driver's auto policy is the primary source of recovery. If that policy is insufficient, the cyclist may have their own auto insurance policy with underinsured motorist coverage that applies — even though they weren't in a car. Not all cyclists know this, and not all attorneys think to check.

Hit-and-run situations are not dead ends. If the driver fled, uninsured motorist coverage may provide a path to recovery. There are specific procedures for preserving those claims in Alabama, and they have to be followed correctly.

The Evidence That Matters In A Bicycle Accident

Getting the evidence right early is the difference between a strong case and a settled-for-nothing case.

Camera footage — Intersection cameras, business surveillance cameras, and dashcam footage from nearby vehicles can capture exactly what happened. Footage is overwritten on short cycles. It has to be requested immediately.

Physical evidence — The position of the vehicles, skid marks, bike damage, and road markings all tell a story. Photographs taken on the same day, at the same time of day, under similar conditions, create a record that can't be revised later.

Witness statements — Cyclists are frequently hit in populated areas. Witnesses exist. Getting their accounts on record before they become unavailable matters enormously.

Medical documentation — The full arc of bicycle injury treatment — ER, specialist care, physical therapy, neurological follow-up, long-term orthopedic care — must be tracked completely. Partial medical records undercut settlement value.

Helmet and gear documentation — If a helmet was worn and sustained damage, it should be preserved. It's physical evidence of impact force and protection.

What We Offer

Chris Simmons personally handles every bicycle accident case Simmons Law accepts. He understands the specific fault arguments that get deployed against cyclists in Alabama and knows how to counter them with evidence — not just argument. He knows where to look for footage, how to build the medical record, and how to structure the demand so the full scope of the cyclist's loss is documented and supported.

Chris is in Birmingham and Mobile, serves clients throughout Alabama, and answers his own phone. He has recovered $1.6M, $1.2M, $1M, $750K, and $500K in documented results for Alabama injury clients. He prepares every file for trial — because that preparation changes the offer long before a jury is seated.

What Happens After You Call Chris Simmons

Immediate assessment — Chris hears the full story, evaluates the case, and gives you an honest read on what it's worth and what it will take to build it.

Footage and evidence preservation — Camera footage requests go out immediately, before overwrite cycles eliminate the record.

Medical record tracking — Full treatment documentation from ER through all follow-up care, tracked so every injury is accounted for in the demand.

UIM coverage review — Your own auto policy is checked for underinsured motorist coverage that may apply to you as a cyclist. This is a commonly missed recovery source.

Fault record protection — The "cyclist was at fault" narrative gets challenged with physical evidence and witness testimony before it takes hold in the record.

Demand and resolution — Built on complete documentation. Negotiated from strength. Trial-ready if necessary.

Bicycle accident cases handled personally by Chris — not minimized, not handed off, not treated as low-priority
Millions recovered for Alabama injury clients — documented results up to $1.6M
All coverage reviewed — at-fault driver's policy, UIM coverage, and hit-and-run options all evaluated
Evidence preserved fast — camera footage, witness statements, and physical evidence secured before they disappear
Direct attorney access, 24/7 — Chris's personal cell, not an answering service

Before You Talk Yourself Out of Calling

"I wasn't wearing a helmet."
Helmet use may be raised by the defense to suggest you worsened your own injuries. That doesn't eliminate your case. It requires careful handling of the medical record and the fault argument — which is exactly what Chris provides.

"The driver stopped and their insurance called right away."
Speed from the insurer means they want to close before your injuries fully develop. An early call is not the same as a fair offer.

"I was using the road, not a bike lane — I might be partly at fault."
Cyclists have the legal right to use Alabama roads. Whether your road position contributed to the crash is a factual question, not an automatic finding. Chris reviews the actual facts before accepting any fault narrative.

"I can't afford legal help."
Chris works on full contingency. Zero out of pocket. You pay nothing unless he recovers money for you.

Free Case Evaluation — Know What Your Case Is Really Worth

Don't let the insurance company close your case on their terms. One call with Chris tells you what happened, who's at fault, what policies apply, and what your injuries are actually worth. Most calls reach Chris directly within minutes.
